Applies to consumers (§ 13 BGB). Entrepreneurs have no right of withdrawal; they have the contractual rights under § 6 of the Terms.
1. Withdrawal instruction
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us
Matthias Anderer GmbH

Email: support@snapories.com
Phone: +49 151 22837719
of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
You may also exercise your right of withdrawal online, using the "Vertrag widerrufen" (withdraw from contract) control in the organiser dashboard on snapories.com. If you use that online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without undue delay, stating the content of your withdrawal declaration and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the provision of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

2. Online withdrawal: the "Vertrag widerrufen" control
2.1 Because you conclude this contract through an online interface, we provide a withdrawal function there (§ 356a BGB). The control is labelled "Vertrag widerrufen" (withdraw from contract).
2.2 Where it is. The control sits in the organiser dashboard, which you open with the admin master key generated at booking; the booking confirmation also links to it. It is continuously available throughout the withdrawal period, prominently placed and easily accessible.
2.3 What you enter. The function asks for your name, the details identifying the contract — booking or event number — and an electronic address at which we can send you the acknowledgement of receipt. Details already known to us are pre-filled for you to confirm.
2.4 Two steps. You then submit the declaration using the "Widerruf bestätigen" (confirm withdrawal) control. Only this second step triggers the withdrawal.
2.5 Acknowledgement of receipt. Without undue delay after submission, we send you an acknowledgement of receipt on a durable medium — as a rule by email — stating the content of your withdrawal declaration and the date and time of its receipt.
2.6 Meeting the deadline. If you sent the declaration through the withdrawal function before the withdrawal period expired, it is deemed to have reached us within that period (§ 356a (5) BGB).
2.7 An additional route. The withdrawal function sits alongside the other routes. A withdrawal by email, by letter or using the model withdrawal form is equally effective.
3. Early expiry of the right of withdrawal, and compensation for value
3.1 What you book is a digital service. Snapories enables you and the guests of your event to create, store and jointly use images, and to access them (§ 327 (2) sentence 2 BGB). Expiry of the right of withdrawal is therefore governed by § 356 (5) BGB — the rule for services, not the one for digital content.
3.2 When the right expires. Your right of withdrawal expires early only upon complete performance of the service, and even then only if, before performance began, you
a) expressly requested and agreed that we begin performing the service before the withdrawal period expires, and b) acknowledged your awareness that you lose your right of withdrawal upon our complete performance of the contract.
The beginning of performance therefore does not extinguish your right of withdrawal. Until performance is complete it remains in place, unless it has already ended through expiry of the fourteen-day period. Because the contract comprises two separately priced services, expiry occurs for each of them at its own point in time (clause 3.3).
3.3 Two services, two points in time. What you book consists of two separately priced services (§ 2.5 and § 4.1 of the Terms):
a) the event service — live gallery, film roll and AI photobooth during your booked event period. It is performed completely upon expiry of that period; your right of withdrawal expires for that part at that point. b) the hosting service — your images then remain available for at least 30 days (§ 14.2 of the Terms), namely to you as the Organiser, with the ability to provide your guests with a time-limited share link from them. Guests' access to the gallery ends when your event period ends. The hosting service is performed completely only upon expiry of that availability period; until then it remains withdrawable, even where your event has already taken place.
3.4 Compensation for value. If you withdraw after performance has begun at your express request, you owe us a reasonable amount for the performance rendered up to withdrawal (§ 357a (2) BGB). The calculation is based on the separately stated prices of the two services under § 4.1 of the Terms: where the event service has been completely performed, it is charged at its own price; of the hosting service, only the share corresponding to the part of the availability period elapsed up to your withdrawal is charged.
3.5 What you confirm during checkout. If your event begins within the withdrawal period, we obtain your request and your acknowledgements expressly before the booking is submitted — in these words:
I expressly request and agree that Snapories begins performing the service before the withdrawal period expires. I am aware that my right of withdrawal expires upon complete performance of the service, and that on withdrawal after performance has begun I owe a reasonable amount for the performance rendered up to that point.
On every booking we additionally draw your attention to the split of the service during checkout, in these words; where the declaration above is obtained, this notice sits immediately alongside it:
Your booking comprises two services, each at its own price: the event service — live gallery, film roll and AI photobooth during your event period — and the hosting service — your images then remain available for at least 30 days, to you as the Organiser; your guests reach the gallery only during the event period and receive the images afterwards through a share link from you. Both prices are stated in § 4.1 of the Terms; the split does not change the total price shown. The event service is completely performed at the end of your event period, and your right of withdrawal expires for that part at that point. For the hosting service it remains — if you withdraw during that time, you owe only the time-proportionate share already performed.
3.6 Without that request we begin performance only after the withdrawal period has expired.
4. Effects of withdrawal in detail
4.1 Reimbursement within 14 days. We reimburse the payments received no later than within 14 days (§ 357 (1) BGB), counted from the day your withdrawal declaration reached us.
4.2 The same means of payment. For the reimbursement we use the same means of payment you used for the payment (§ 357 (3) BGB). Anything else applies only where it has been expressly agreed and causes you no costs. In no case do we charge you a fee for the reimbursement.
4.3 Set-off. Any compensation for value owed under clause 3.4 is stated separately in the settlement and set off against the amount reimbursed.
4.4 Further use after withdrawal. After withdrawal you may not continue to use the service or make it available to third parties; we are entitled to prevent further use (§ 357 (8) in conjunction with § 327p (1) BGB). The event is closed to new captures.
4.5 Handing back your content. At your request we provide you with the content you provided or created while using the service free of charge, without hindrance from us, within a reasonable time and in a commonly used, machine-readable format (§ 327p (3) BGB). In practice this is the download of the event gallery as image files in their original format. Excluded is content that has no use outside the service, that relates solely to your use, or that has been aggregated with other data (§ 327p (2) sentence 2 nos. 1 to 3, (3) sentence 2 BGB).
4.6 No further use by us. We make no further use of content that is not personal data after the contract has ended (§ 327p (2) BGB). How we handle personal data is set out in the Privacy Policy.
